1. Acceptance of Terms

By accessing or using this website, purchasing products, or participating in any events or promotions hosted by Smokin’ Arts, LLC, doing business as Art On Wheels (“Company,” “we,” “our,” “us”), you agree to these Terms of Service. If you do not agree, you may not use this website.

2. Handmade Product Disclaimer

All products are handmade or hand-finished. Variations in color, texture, placement, design, and print quality are normal and expected. Each item is unique.

All sales are final. Because of the handmade and custom nature of our items, we do not accept returns, exchanges, or cancellations except in cases of verified manufacturing defects.

3. Custom Orders

Custom orders are created using the details, images, and information provided by the customer. We are not responsible for typos, incorrect details, low-resolution images, or any errors submitted by the customer. Once a design or mockup is approved (if applicable), no further changes may be made.

4. Large Custom or Business Orders

Bulk orders, business orders, and large quantity purchases may require a non-refundable deposit, a separate agreement, and extended processing times. These terms will be provided in writing before production begins.

5. Shipping Policy

We currently ship within the United States only.

Once an item leaves our possession and is scanned by the carrier, it becomes the responsibility of the shipping carrier. We are not responsible for delays, lost packages, damaged packages, delivery errors, or theft after delivery. Customers must contact the carrier directly for claims.

Tracking information will be provided once the order is fulfilled.

6. Local Pickup Policy

Local pickup may be offered by mutual agreement. Items not picked up within 30 days may be considered abandoned and will not be refunded.

7. Payment Methods

We accept the following payment methods:

• Shopify credit/debit checkout
• Zelle
• Cash App
• Cash (local pickup or in-person events)

We do not accept PayPal or Venmo.

8. Age Restrictions

Customers must be 18 years or older to make purchases or participate in raffles and official promotional events such as the Gingy Hunt. Minors may attend public events only when accompanied by a parent or legal guardian.

9. Intellectual Property Rights

All artwork, designs, graphics, characters (including all Gingy characters and storylines), images, text, and logos are the exclusive property of Smokin’ Arts, LLC. You may not copy, reproduce, distribute, sell, or modify any content without prior written consent.

10. Limitation of Liability

To the fullest extent permitted by law, Smokin’ Arts, LLC is not liable for any damages or losses resulting from misuse of products, allergic reactions, website errors, participation in physical events, carrier issues, injuries during events, or any other incidental or consequential damages. Participation in any activities hosted by the Company is voluntary and at your own risk.

11. Governing Law

These Terms of Service are governed by and interpreted in accordance with the laws of the State of Oklahoma, without regard to conflict of law principles.

12. Changes to Terms

We reserve the right to update or modify these Terms of Service at any time. Updated terms will be posted on this page with the revised “Last Updated” date.
